Kroy Biermann escalates his divorce from Kim Zolciak by filing for sole custody of their four minor children in a Georgia court.
Details of Biermann’s Filing
The retired NFL player, aged 40, seeks full custody, alleging Zolciak, 47, neglects basic parenting duties. Court records show Biermann claims she missed nearly all scheduled parenting time from February 26 to March 29 due to international travel.
Biermann notes only one instance of compliance on March 9, when one child suffered a dog bite. He accuses Zolciak of entering their January 27 mediation agreement in bad faith, committing fraud and deceit while pushing for joint custody.
Additional claims include Zolciak allowing children to skip therapy sessions on her parenting days, failing her own required therapy meetings, and lying to therapists. Biermann argues her noncompliance endangers the children and makes the current plan unworkable.
He plans to present expert and witness testimony proving Zolciak unfit, requesting immediate sole custody in the children’s best interests.
Zolciak’s Response
Zolciak’s representative calls the accusations “completely false,” labeling the filing a “deliberate attempt by Kroy to defame my character.”
Zolciak states: “I spent five weeks away working on two TV shows to support my family and make sure my children are cared for—something I will never apologize for. I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent; the truth is on my side, and it will come to light—no matter how hard anyone tries to bury it.”
Family and Divorce Background
The couple shares sons KJ, 14; Kash, 13; and twins Kane and Kaia, 12. Zolciak has two adult daughters, Brielle, 29, and Ariana, 24, previously adopted by Biermann.
Separated since 2023, Biermann first filed for divorce in May 2023. Zolciak filed soon after. They reconciled briefly in July before he refiled in August 2024 and again in early 2025.
Previously, Biermann sought sole custody in August 2025, citing neglect and emotional abuse. They shifted to a split-custody arrangement after losing their Georgia mansion to foreclosure in April 2025.
In June 2025, Zolciak accused Biermann on Kristin Cavallari’s podcast of failing to provide financially: “I’ve worked my a** off to provide for my family and my children. This man has not paid a bill in this house in years. Even with a job, he hasn’t paid a bill in this house in years. Not clothes for my children, not extracurricular [activities], nothing.” She has also previously pursued sole custody.
