A desperate 64-year-old man attempted to rob an HSBC branch in Broadstairs, Kent, using a large black vape disguised as a gun, but alert staff foiled the plan by walking away and notifying police.

The Failed Heist

Security footage from January 29 captures Gary Fishlock, from Birchington, Kent, passing a note to bank clerk Eleanor Gater at the Westwood Cross shopping centre branch. The note demanded: ‘I have a gun, put the money in the bag.’

Fishlock gestured toward his coat pocket, pushing forward the vape to mimic an armed threat, while holding a crumpled plastic bag in his other hand. Experienced staff member Ms. Gater remained calm, wrote a note on her tablet, and approached colleague Tanya Pinn.

As Fishlock followed, demanding money, Ms. Pinn activated a personal alarm. The women retreated to an office, contacted police and security, and left Fishlock waiting. Armed officers arrived shortly after, arresting him on site.

Court Proceedings and Sentence

At Canterbury Crown Court, Fishlock pleaded guilty to attempted robbery and possession of an imitation firearm with intent to cause fear of violence. Judge Alison Russell sentenced him to two years in prison.

The judge emphasized the terror inflicted on staff: ‘The fear and panic must have been considerable.’ She acknowledged his desperation—preferring incarceration over homelessness—but rejected any notion of triviality.

‘Members of the public are free to go about shopping centres without the fear that someone will rock up with a note claiming to have a gun,’ Judge Russell stated. ‘Members of bank staff have the right to go to work without expecting this.’

Prosecutor Paul Valder noted the five-minute ordeal ended with Fishlock awaiting arrest. In interview, Fishlock admitted using the vape to simulate a weapon. Ms. Gater reported ongoing anxiety, her ‘stomach dropped’ upon reading the note.

Personal Circumstances

Fishlock’s downfall began on Christmas Eve when his stonemason employer terminated his services. His 14-year partner soon ended the relationship, evicting him and leaving him facing homelessness and depression.

Defense counsel Kieran Brand described his life ‘crashing down,’ expressing deep remorse for the shock to staff. Judge Russell ordered destruction of the vape used as the imitation firearm.
